1. ACCEPTANCE OF TERMS

These terms and conditions (“Agreement”) apply to your purchase of the educational software, and your access to The Smart Education Foundation online scholarship guide, and/or related products and/or services and support (“Product”) in the United States by The Smart Education Foundation entity named on the associated financial statement provided by your creditor, bank, or other institution. By accepting delivery of the Product, and clicking the ACCEPT tab at the bottom of this page, you accept and are bound to the terms and conditions of this Agreement. If you do not wish to be bound to the terms and conditions of this Agreement, you must notify the SEF immediately and return your purchase pursuant to The Smart Education Foundation’s return policy (See the website for more details). These terms may be updated by us from time to time without notice to you. THIS AGREEMENT SHALL APPLY UNLESS(I) YOU HAVE A SEPARARTE PURCHASE AGREEMENT WITH THE SMART EDUCATION FOUNDATION, IN WHICH CASE THE SEPARATE AGRREMENT SHALL GOVERN; OR (II) OTHER SEF TERMS AND CONDITIONS APPLY TO THE TRANSACTION.

2. DESCRIPTION OF SERVICE

The SEF provides it’s users with access to a copy written online scholarship guide for a monthly fee of $54.95. (“Service”) This monthly recurring transaction will continue unless the service is cancelled. (See the website for further details on our cancellation policy). SEF provides users with access to a rich collection of resources, including available scholarships nationwide, shopping services, personalized content and branded programming through its network of properties. The monthly charge of $54.95 will enable users to browse, apply for, and contact available scholarships for nationally recognized universities. Users are encouraged to apply for as many scholarships as possible, and will continue to have access to our scholarship guide as long as they accept the monthly charge of $54.95. Once the user decides to cancel their membership in the scholarship guide (which may be provided in whole or part by a third party), they will no longer be charged the monthly fee, and access to the extensive scholarship guide will be denied.

3. SEF PRIVACY POLICY

Registration data and certain other information about you is subject to our Privacy Policy. For more information, see our full privacy policy on our website. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by The Smart Education Foundation, and its affiliates.

4. MEMBER CONDUCT

You understand that all information, data, text, software, or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content is originated. This means that you, and not SEF, are entirely responsible for all the content that you upload, fill out, contact, post, email, transmit or otherwise make available via the scholarship guide (“Service”). Under no circumstances will The Smart Education Foundation be liable in any way for any Content, including to but not limited to, and errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service.

By accessing or using this Site, you agree to these terms of use, conditions and all applicable laws. If you do not agree to these terms you may not use this site.

6. MODIFICATION OF THESE TERMS OF USE

The Smart Education Foundation reserves the right to change the terms, conditions, and notices under which the SEF Sites are offered, including to but not limited to the charges associated with the use of the Service and Sites. You are responsible for regularly reviewing these terms and conditions.

7. USE OF THE SITE

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Smart Education Foundation Web Sites. Copy writes and Trademark infringements will be prosecuted to the fullest extent of Illinois and Federal law.

8. INFORMATION PRESERVATION

You acknowledge, consent and agree that The Smart Education Foundation may access, preserve, and disclose information and Content if required to do so by law or in good faith belief that such access preservation or disclosure is reasonably necessary to (a) comply with legal process; (b) respond to claims that any Content violates the rights of third parties; (c) respond to your requests of customer service; or (d) protect the rights, property or personal safety of SEF, its users and the public.

YOU UNDERSTAND BY ACCEPTING THESE TERMS AND CONDITIONS, THE TECHNICAL PROCESSING AND TRANSMISSIONS OVER VARIOUS NETWORKS OF THE SERVICE, INCLUDING YOUR CONTENT, MAY INVOLVE (a) TRANSMISSIONS OVER VARIOUS NETWORKS; AND (b) CHANGES TO CONFORM AND ADAPT TO TECHNICAL REQUIREMENTS OF CONNECTING NETWORKS OR DEVICES.
